Liberty of Conscience and Individuality Essay Example | Topics and Well Written Essays - 1500 words

Liberty of Conscience and Individuality - Essay Example Individuality means one separate object or one only and it is a quality of state as being an individual. Besides, it also includes the status of independence. The main focus of this paper in presenting the concept will be Chapter 3 of On Liberty by John Stuart Mill. In this chapter, he describes about importance of individuality and freedom of action. Mill has composed this chapter by indicating the limitations of personal freedom. He points out his belief in self government excluding individuals who are interfering in others liberty. He also dwells on the significance of a person’s wishes and incitements such as incitement produces energy, which will be the fuel for change and actions, including both good and bad. Mill states that the religious and other forces stifle the individuality of persons and he does not believe in the restrictive view, which is injurious to the inner good of humans. He also emphasizes on the significance of original thought and naturalness. Mill beli eves that even if the people do not hold on freedom and naturalness, they will automatically mingle with that environment. It is because of the government, which become more effective only if there is a society, allows people to innovate and spread new ideas and to confront the majority’s opinion. ... It meant to be a society, who allows people to select their choice in life. The quote elaborates on different social activities of religious worship, family organisation of changing and testing all aspects in life which none can imagine. He actually means that every person should be allowed to live in his or her own way and it should be controlled only when they are interfering in other’s life. He also points out the reasons which support experiments of living. There is a bilateral meaning on the argument – the author tells that there do exist unsatisfactory factors in our society, and allow the growth of experiments of living taking place. Mill highlights other lifestyles. Mill illustrates that freedom within the society will lead to the formation of genius, and he believes that genius can live only in a free society. Besides, he thinks that religious freedom is one of the important aspects of liberty. Therefore, people who are taking offence against others are unaccep table and that some modifications should be made to the current understanding of liberty. Mill expresses his view that moral principles are important for a person’s freedom that he does not harm others. On the contrary, through the concept of making harm, Mill shows the rational point of view and the changes such action can bring about in the society. Individuality is one of the main topics of discussion in Mill’s On Liberty. It may differ from person to person. Mill, quoting the words of Wilhelm von Humboldt, who was a German thinker and a politician, argues that each person’s motive is the â€Å"highest and most harmonious development of his powers to a complete and consistent whole†

Leith Agency Case Study Example | Topics and Well Written Essays - 750 words

Leith Agency - Case Study Example This is clearly evident in the Tennents Lager, a beer brand in Scotland, wherein it had good market share with one out of four pints consumed, but it wasn't popular among younger population. The question why younger lots were not drinking the Tennents Lager was a critical incident and the challenge was to make them believe that it was their brand (Lieth Agency case study). Lieth Agency can identify the critical incidents in the similar manner by analyzing the product and its marketability as in the above mentioned case. It is necessary to assess customer satisfaction as it is the best lead indicator of future loyalty as mentioned by Hill et al (2003:3). It is further stated that customer satisfaction will enable to know whether their expectations have been met, identify priorities for improvement for customer satisfaction and set goals for service improvement and monitor progress against a customer satisfaction index. Customer satisfaction is measure of how your organizations "total product" performs in relation to a set of customer requirements. (Hill et al, 2003:6). Similarly Vavra (1997:3) states that customer satisfaction measurement is formalized, objective tool for assessing how a business treats its clients and employees as well who testify that an organization is quality oriented. In regard to Leith Agency, the company can assess its customer satisfaction through product survey and its improvement index in terms of sales and its market share after the campaign. This will give an insight int o the effect of advertising campaign on the particular product which will in turn help in assessing the customer satisfaction. Merits of Servicescape Framework The concept of a servicescape developed by Booms and Bitner emphasizes the impact of the physical environment in which a service process takes place (Ghanghas,M n.d) wherein it plays an important role, both negative and positive, in customer's impression formation (Lin, 2004:163-178). According to Lin (2004), servicescapes are an important tangible component of the service product that provide clues to customers and create an immediate perpetual image in customers' minds. At Leith Agency, customers can encounter interpersonal servicescape as the company has to provide few ideas and samples of the ad campaign, discuss the changes required and then strike a deal while completing talks in financial matters. The framework plays important roles as package, wherein the customer is allowed to see a sample of their product or what they are going to get, so that client gets what he wants; facilitator, providing equal opportunities for both customers and service employees; socializer, providing cordial and friendly atmosphere to the customers in the office and differentiator, wherein the appearance and ambience of the workplace leaves an overall impression on the customers and provides pleasant atmosphere for its employees to work (Ghanghas, M, n.d).. The merits of servicescapes as mentioned above like package, facilitator, socialzer and differentiator will be helpful to the agency in developing a cordial atmosphere among its employees and making it stand apart from its competitors. Moreover, a difference in the type of working and ambience is itself a creative thinking which may entice the existing and future customers. References 1. CALT Learning (2007)

Frustration Essay Example | Topics and Well Written Essays - 1250 words

Frustration - Essay Example The discussion in this paper is intended to be inclined to the case AS v Wijsmuller BV (The Super Servant Two), [1989] EWCA Civ 6, [1990]. The doctrine of Frustration under the contract law intends to reveal a number of propositions contextualized in the case AS v Wijsmuller BV. Some of these propositions include evolving to ease the rigor of the common law’s avowal on factual performance of unlimited promises, outcome of frustration to end the contract and an event must occur without a liability on the side of the party seeking to depend on it2. The Purpose of this paper is to analyze the statement â€Å"Since the consequence of frustration is to eradicate the contract and eject the parties from supplementary burden under it, the doctrine is not to be unconscientiously invoked, but must be kept inside much contracted limits and ought not to be unmitigated†. The discussion in this paper is intended to be inclined to the case AS v Wijsmuller BV The doctrine of frustratio n exhibits complexity when determining the cases in this context3. Some of the examples of frustration include destruction of the specific object, which is fundamental for execution of the contract, personal incapability, and non-occurrence of a particular event, state interference, delay and supervening illegality4. For the case of the AS v Wijsmuller BV (The Super Servant Two), [1989] EWCA Civ 6, [1990], the aspect of frustration is inclined to personal incapability, destruction of the specific object and supervening an illegality5. This case remains one of the landmark rulings in the history of contract law practice. The aspect of liability when considering the frustration doctrine creates a concern of narrow limits because of numerous reasons. For instance, the express provision for frustration is limited to the scope of not superseding over the express contractual provision for the exasperating occurrence. In fact, it becomes difficult to ascertain the extent of a frustrating e vent, particularly when its occurrence is inclined to the self-inducement and foreseeability of the event6. In essence, the narrow limits of the frustrating events should be a fundamental consideration in the endeavor to minimize the extent of frustration effects. This study reveals that the effects of contract frustration can only remain relevant if the doctrine is applicable. The aspect of causation forms the epicenter of argument in this case. It is notable that, the contract undergoes frustration when Wijsmuller submitted a fortnight later that, the contact could not be performed. The question of causation is evident and any judge would consider a case in which a seller is in a position to aver the defense of a clause, which defends him in situations where fulfillment is stalled by the exempt threat7. The consequent delivery of his accessible stock to other clientele will not be considered as autonomous cause of inadequacy, as long as when making such delivery the seller acted i n a reasonable manner in all situations of the case. This consideration should be kept within narrow limits to avoid unwarranted liability. Considering that, Dan King contract had been accorded carriage by Super Servant Two without a substitute and in the event that, the vessel had been lost before the time of carriage, then with ultimate assumption of non- negligence by Wijsmuller, it is probable that, the con
